To Qualify as an Immigrant Investor, an Applicant Must:
• have net assets of at least 1,600,000 $ CAD acquired through his/her own legal economic activities
• have at least 2 years of full-time management experience (planning, management and control of material, financial and human resources) acquired in an industrial, commercial or agricultural business enterprise that is profitable and legal (for each of the 2 years in question)
• undertake to invest, for five years, 800,000 $ CAD through a securities broker recognized by the Commission des Valeurs Mobilières du Quebec (Quebec Securities Commission). An Investment Agreement is signed with the said securities broker. The amount will be invested with IQ Immigrants Investisseurs Inc., a subsidiary of Investissement Quebec for the purposes of financing an aid program for Quebec based small and medium-sized businesses. The investment is fully guaranteed by the Government of Quebec.
• declare an intent to settle in the Province of Quebec.
The Process
• Applicants must be represented by an immigration lawyer or consultant who is an agent of a financial intermediary.
• An Application for a Quebec Selection Certificate is completed for the Applicant and his/her Spouse or De Facto Spouse as well as for any Dependent Child Aged 18 or Over, an Appendix Form for business immigrants and a Declaration by Spouse or De Facto Spouse is submitted through one of the Quebec Immigration Bureaus around the world.
• Moreover, the applicant and, where applicable, his/her spouse or de facto spouse must complete and sign the following annexes: where applicable, the Declaration of a Candidate Exercising a Profession Governed by a Professional Corporation; where applicable, the Declaration of a Physician who Graduated Abroad; where applicable, the Declaration of a Candidate Exercising the Profession of Elementary or High School Teacher.
• The applicant signs an Investment Agreement and a Power of Attorney, empowering the financial intermediary to act on the Investor's behalf in investing the funds and dealing with the Quebec authorities
• An immigration application is submitted to a Quebec Immigration Bureau, together with the original of the Investment Agreement and other required documentation.
• The Quebec immigration authorities evaluate the application and conduct an interview at one of the Quebec Immigration Bureaus abroad, in the country of residence of the applicant or, if requested, in Montreal.
• After an acceptance by the authorities, the funds to be invested are deposited in the Investor's personal account at the financial intermediary, subsequently transferred to IQ Immigrants Investisseurs Inc., a subsidiary of Investissement Quebec for the purposes of financing an aid program for Quebec-based small and medium sized businesses.
• IQ Immigrants Investisseurs Inc. issues a Term Note guaranteeing the complete investment amount. This Term Note is underwritten by the Government of Quebec.
• A Quebec Selection Certificate is issued by the Quebec immigration authorities.
• The investment is made by the financial intermediary.
• Canadian immigration authorities conduct a medical and criminal background verification and issue a Canadian Permanent Resident Visa
• Investors are welcome to land in Canada (Quebec).
The Options
With Financing
Requires a payment of 220,000 $ CAD from the Investor. The financial intermediary shall secure a bank loan of 580,000 $ CAD on behalf of the Investor. The initial payment of 220,000 $ CAD is used to pay the interest on the bank loan and other financing charges. No balance is repaid to the Investor at the end of the five (5) year term.
Without Financing
Requires a payment of 800,000 $ CAD from the Investor. At the end of the five (5) year term, 800,000 $ CAD is repaid to the Investor.
Services
File Review
An in-house Canadian lawyer will review the Investors' immigration application and all related supporting documents prior to submission or prior to the Selection Interview with the immigration authorities in order to ensure that all applications are as well prepared as possible.
Interview Preparation
An in-house Canadian lawyer will meet with the Investors and personally prepare them for their Selection Interview with the immigration authorities, also at no cost to investor applicants.
Interview Attendance
An in-house Canadian lawyer will attend Investors' selection interviews anywhere in the world, at no cost to investor applicants. (Please note that this service is only available for the Quebec Immigrant Investor Program since the Federal government does not permit the presence of lawyers at interviews in the context of the Canada (Federal) Immigrant Investor Program.)
Administrative Review and Appeal
Although it is rare for our clients to be refused by the immigration authorities, our lawyers will prepare a Request for an Administrative Review in the event that an application is unjustifiably refused. This service is also provided at no cost to investor clients. |
